Aqari Application Usage Agreement

Introduction

This Usage Agreement, Privacy of Use, Terms and Conditions, and all policies posted on Aqari application developed to protect and preserve the rights of (Aqari Application) and (customers who use the application with or without registration).
By accessing and using Aqari website or application, you acknowledge and agree, without making any modification and without any restrictions or alterations, to the terms and conditions contained in this (Agreement). You represent and warrant your legal right to enter into this Agreement and to use the Application in accordance with all terms and conditions herein.
As much as possible, the Aqari application seeks to provide information on its application with extreme accuracy. However, some errors may appear from time to time. Aqari application is not responsible for any error in the information contained on the website or application.
Aqari application is a 100% Qatari company with headquarters located in Doha. It is referred to in this agreement as (Aqari Application), (we), or (us), and here it represents the first party.
“Customer” is an individual, corporation or company who access the application and benefit from its services directly or indirectly, whether by registration or without registration, and it is either an advertiser, a willing buyer, a renter, a real estate office, or a real estate marketer, and here the second party is represented.
The terms, conditions and provisions of this agreement and legal disputes are subject to the laws, legislation and regulations in the State of Qatar.

Terms of use

As the "second party" to this agreement, by agreeing to benefit from the application's services, you must comply with the following:

Not to advertise or upload content or items that are inappropriate for the ratings available in the application that are allowed to be sold. You should review the advertising terms.
Not to breach or circumvent the laws, policies and regulations of the application or any rights related to a third party.
Do not copy the advertisement from Aqari application and republish it on other sites.
Not to use any illegal means to access ads or data of other users, violate the policy and rights of the Aqari application, access the content of the application, or collect and collect information and data related to the Aqari application or the customers of the application. And take advantage of it in any way or republish it.
Not to violate the restrictions on the application or the application, or to bypass or circumvent the violation of other measures used with the aim of preventing or restricting access to this application.
Not to use our Services if you are not legally qualified to perform this Agreement, for example you are under 18 years of age or you are temporarily or permanently banned from using the Application.
Not to manipulate prices, whether in buying or selling, and causing harm to other customers.
Not to publish fake, speculative, inaccurate, misleading, or deceptive ads, and it is possible for Aqari application to cancel, without prior notice, all unreal ads.
Infringing, harmful, threatening, abusive, tortuous or racist material; or morally inappropriate or otherwise unlawful content or information.
Not to forget any file attached to Aqari application.
Not to copy the advertiser's right in any advertisement that has been added.
Do not transfer your account or activity to other sites at the time it bears our logo or services.
Violate the copyrights, trademarks, patents, publicity, databases or other property or intellectual rights that belong to or licensed to the application.
Not to violate others' property, intellectual or patent rights.
Not to collect information about other application users for commercial or other purposes.
Not to do anything that might harm the reputation of the Aqari application.
Aqari application, its representative or employee, or any description that suggests that you are affiliated with the company, unless you have official permission from the company.
Not to obtain or attempt to gain unauthorized access to the Application or any account of a Member on the Application Or impersonate any person or misrepresent membership with another person.
You will not use any automated device, software or means to access, retrieve, copy or index the Application and/ or our website or any content on the Application.
Not to perform any action that imposes any burden or causes an increase in traffic demands on our infrastructure that we deem, in our sole discretion, to be an unreasonable or inappropriate use of the Application.
Not to use or index any content or data on the application for the purposes of:
1. Build or fill a searchable database for real estate.
2. Building a database of real estate information.
3. Compete with us in any way we have not specifically authorized.
Not to send or attempt to transmit any computer viruses, worms, defects or any other destructive material.
We reserve the right to exercise any measure we deem necessary to prevent unauthorized access to the use of the Application, including without limitation, erecting technological barriers, or reporting your conduct to any person or entity.
It is your own responsibility to comply with all our Terms and Conditions which include the full and timely payment of all amounts due and compliance with all rules relating to fees.

If it appears to the Aqari application and website that you have breached any of these terms and conditions, and on the other hand, prove otherwise when using the application or website. It reserves the right to:

Terms of advertising in Aqari application

The advertisement must be for selling or renting a property only.
The advertiser is committed to the validity of all entered information.
The advertisement must be full of details and in the correct section.
The Application has the right to delete any advertisement without mentioning the reason for the deletion.
It is forbidden to copy any advertisement from the application.
It is forbidden to use any part of any advertisement in the application.
The advertiser is obligated to have the images added to the advertisement for the same property as the one being advertised.
The advertiser is obliged to attach realistic pictures of the advertised property.
If it is an individual, the advertiser is obligated to put the title deed, and in the case of a company, to put the title deed and the commercial register as well.
The advertiser is obligated not to attach model images or symbolic images.
The advertiser is obligated to follow up and update his advertisement continuously.
The advertiser is obligated to follow up on the interaction of visitors.
The advertiser is obligated to close the advertisement after the rental or sale process.
The advertiser is obligated to pay the advertising fees shown to him.

* The amount paid for the ad is non-refundable once the ad is approved and the ad is displayed.

Responsibility of Aqari application

Aqari application was created to be comprehensive for all types of real estate throughout the State of Qatar. Aqari application provides various real estate services and the ability to search or advertise real estate. It allows communication with the advertiser directly and that the advertiser is responsible for the validity of the advertisement details, including the supporting papers that have been attached and commitment According to the laws and regulations applied in the country with regard to the sale and marketing of real estate, and it is important for the customer to understand that all responsibility lies with the advertiser directly, and the advertiser is automatically classified by the system based on his activity, for example (an individual or a company).

Aqari application does not provide any guarantees and does not assume any responsibility in the event that the user does not comply with the policy of using the application , and we are not responsible for any risk, damages, consequences or losses that fall on the seller, buyer or any other party, and those who suffer damage should inform us of that By contacting the following e-mail : [email protected] and explain the damage to it, and the Aqari application will take action according to the type of incident without any responsibility.

*And you should review the security policy for the Aqari application to find out what actions to take when you suffer some kind of damage. *And your registration in the Aqari application means that you authorize us to save your data that you entered on the company's servers, and we have the right to view and review it. 4. Aqari application will not be a party to such cases and does not bear any responsibility, but we will provide what has been documented to the competent authorities if this is requested.
Infringement of the policy or sovereignty of the state: the incident will be documented, the advertisement will be deleted, the advertiser's membership will be suspended, and the competent authorities will be informed of that.
In the event of selling any of the prohibited goods: the advertisement will be documented, archived, deleted, the member suspended, and the competent authorities notified.
In the event that an individual, institution or company illegally (such as hacking or using illegal data collection methods or any means) with the aim of accessing the application’s content, application programming , application databases , or information and data belonging to application customers in order to Copying and republishing ads or making use of them in any way, the Aqari application directs to the competent authorities to sue the other party on the grounds of electronic hacking and committing a crime of violating the information crime regulations.
If an individual, institution or company copies advertisements from Aqari to another website without the site’s permission. Aqari application will direct the competent authorities to file a lawsuit and prosecute the other party on the claim of infringement of property rights.
Infringement of the property, intellectual or patent rights of a third party:
1. If you believe that one of your rights has been violated, you should contact us to file a complaint at the following e-mail: [email protected] and provide proof of your entitlement to the published advertisement.
2. Aqari application will review the complaint, study it and ensure its validity, and will take the necessary action according to the result, and the complaint will be documented and archived for reference at any time.
3. You must go to the competent authorities if you want to sue the party that violated your rights. Note that the Aqari application will not be a party to the case and is not responsible for it, and we do not bear any responsibility, but we will present what has been documented if the request is made by the competent authorities.
Inconvenience: When a customer is disturbed by another customer, he must notify the management of this, and the complaint will be reviewed, and appropriate action will be taken in this regard.

Account Deletion

Users have the right to delete their account by selecting the "Delete Account" option in the application settings. Upon confirming the account deletion request:

The account will be marked as inactive, and all associated data will remain stored in our database for a grace period of 30 days.
During this 30-day period, if the user logs back into the application, their account and all related data will be restored, and the account will become active again.
If the user does not log into the application during the 30-day period, the account and all related data will be permanently deleted and cannot be recovered.
